Battered Spouses and Children and Parents

Form I-360, Petition for Amerasian, Widow(er), or Special Immigrant

If you are a battered spouse, child or parent, you may file an immigrant visa petition under the Violence against Women Act (VAWA). VAWA allows you to file a self-petition to get a green card without the abuser’s knowledge. VAWA applies equally to women and men. You must complete the Form I-360, Petition for Amerasian, Widow(er), or Special Immigrant, including all supporting documentation and file it with the Vermont Service Center.

In addition to the I-360, there are several other immigration-related benefits conferred on abused non-citizens.
